Supreme Court Victory for Climate Change (2 April 2007)

In the most significant court decision on climate change so far, the US Supreme Court has ruled that carbon dioxide is an air pollutant under the Clean Air Act, in a ruling in a case brought by 12 US States, 4 local authorities and 13 NGOs against the Environmental Protection Agency.

Giving the majority judgment, Justice Stevens noted that "[t]he harms associated with climate change are serious and well recognized", that the "EPA does not dispute the existence of a causal connnection between man-made greenhouse gas emissions and global warming" and that the "EPA has offered no reasoned explanation for its refusal to decide whether greenhouse gases cause or contribute to climate change".
