Federal District Court Rules Against Automobile Industry, Holds that California’s Greenhouse Gas Law Does Not Conflict with Federal Law (11 December 2007)

On 11 December 2007, the United States District Court for the Eastern District of California ruled in favor of the State of California in a case levied against the State by the automobile industry in an attempt to strike down the State’s greenhouse gas law that regulates emissions from automobiles. Judge Anthony W. Ishii held that California’s greenhouse gas law does not conflict with federal law by setting fuel economy standards, or with federal foreign policy, as long as California obtains the Clean Air Act waiver from EPA.
